2011 edition of NCLEJ’s TANF ADA Manual Now Available

The 2011 edition of the NCLEJ ADA-TANF Manual is now posted on NCLEJ’s website, www.nclej.org and can be downloaded free of charge.

The Manual has been revised primarily to address two major legal developments that have occurred since the 2010 edition was released in April 2010:

  • In September 2010, the U.S. Department of Justice issued final revised regulations implementing Title II of the ADA, the Title that applies to state and local government programs and services. Those regulations went into effect on March15, 2011.
  • On March 25, 2011, The Equal Employment Opportunity Commission issued final regulations on the definition of “disability” implementing the ADA Amendments Act.
  • Chapter 3 (Who is Protected by the ADA)
  • Chapter 4 (What Welfare Agencies Must do to Comply with the ADA)
  • Chapter 8 (Welfare Agencies’ Obligation to Provide Effective Communication with Individuals with Disabilities)
  • Chapter 13 (Using Federal Agency Offices for Civil Rights in ADA Welfare Advocacy) have been revised to reflect these changes.

The 2011 edition contains a few other revisions, including the addition of summaries (in Appendix C) of two HHS OCR Compliance Agreements that were signed since the 2010 edition was issued.

The Manual does summarize or discuss all of the changes reflected in the new DOJ or EEOC ADA regulations; rather, it has been revised to be consistent with the new regulations and discusses changes most likely to be relevant to welfare advocates using the ADA on behalf of clients in TANF and other public benefits programs.
